A. Cancellation Policy
Introduction
Consumers have a right of withdrawal under the following conditions, whereby a consumer is any natural person who enters into a legal transaction for purposes that cannot predominantly be attributed to their commercial or independent professional activity:
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without providing any reasons.
The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the last goods.
To exercise your right of withdrawal, you must inform us (Aqualogistik GmbH, Delecker Weg, 30, 59519 Möhnesee, Germany, Tel: 02924/8775-0, Fax: 02924/8775-10, E-mail: info@aqualogistik.com) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax or e-mail). You may use the attached sample withdrawal form, but this is not mandatory.
To observe the cancellation period, it is sufficient for you to despatch the notification of exercising the right of cancellation before the expiry of the cancellation period.
Consequences of withdrawal
If you cancel this contract, we shall reimburse you for all payments we have received from you, including the costs of delivery (with the exception of the additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without delay and in any event no later than fourteen days from the day on which we receive notice of your cancellation of this contract. For this reimbursement, we shall use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this reimbursement. We may refuse to reimburse you until we have received the goods back, or until you have provided proof that you have returned the goods, whichever is the earlier.
You shall return or hand over the goods to us without delay and in any event at the latest within fourteen days from the date on which you inform us of the revocation of this contract. The deadline is met if you dispatch the goods before the expiry of the fourteen-day period.
You shall bear the immediate costs of returning the goods. The immediate costs of returning goods that, by their nature, cannot be returned to us by post under normal conditions (freight forwarding goods) are estimated to be a maximum of approximately €50 for each such good.
You shall only be liable for any diminished value of the goods if this diminished value is due to handling of them which was not necessary to check their nature, characteristics and functioning.
General Information
1) Please avoid damaging or soiling the goods. Please return the goods to us in their original packaging with all accessories and all packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, please ensure adequate protection against transport damage using suitable packaging.
Please do not send the goods back to us without postage paid.
3. Please note that the aforementioned points 1-2 are not a prerequisite for the effective exercise of the right of withdrawal.
